Alina Habba has left her position as New Jersey's top federal prosecutor. This comes after a court battle that questioned her legal standing to occupy the role.

Official Departure

US Attorney General, the Attorney General, confirmed the prosecutor's departure on Monday. Bondi stated that the judicial decision made it unworkable for the official to lead the department effectively.

"But do not mistake adherence to the ruling as defeat," she wrote. "My fight will now extend throughout America."

Legal Background

The departure follows closely on a US appeals court ruled that she had been acting without proper authority as US attorney. This ruling is expected to impact many legal proceedings in the state.

The judicial panel ruled that a interim role that bypassed the advice and consent of the Senate breached the statute on vacant positions.

Future Role and Reaction

The Attorney General added that she will remain at the DOJ as a high-level advisor. She will seek further review of the court's action, aiming for a different outcome.

On a social media platform, Bondi contended that the court "cannot be permitted to override the executive's selection of attorneys entrusted with performing the executive branch's core responsibility of prosecuting crime."

Performance in Office

She praised the prosecutor's work and pointed out that during her run, the city of Newark saw a significant drop in criminal activity. She also stated that the city of Camden experienced its first summer in half a century with no murders.

Legal Career

The 41-year-old attorney, was initially recruited to the former president's legal defense in 2021. She went on to defended her client in his New York criminal case in 2024, leading to his conviction on 34 counts of falsifying business records.

Before assuming the top New Jersey post, Donald Trump had revealed he was naming her as his senior adviser in a potential future term, calling the lawyer as a steadfast ally and a "tireless advocate for justice".
