Federal Court Orders Freedom of Kilmar Abrego Garcia from ICE Custody

A court has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement lacks lawful basis.

"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her order.

The case originates in a mistaken deportation to El Salvador earlier this year, which US authorities later acknowledged was an error. After his repatriation to the United States to answer alien smuggling allegations, he was detained in federal custody.

In her decision, the court noted that the authorities does not have a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."

The legal challenge center on conflicting assertions. While the Trump administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he categorically denies this allegation.

He has also entered a not guilty plea to the conspiracy counts, which are part of a ongoing trial in Tennessee.

The court, who was overseeing his petition to removal in a federal court, determined that he must now comply with the terms of his release from custody in Tennessee. This order effectively transfers his supervision to the Tennessee court.
